Terms of Service

These general terms and conditions (the "Terms") govern access to and use of the online service Ads Manager Tools (the "Service"), published by Winevizer SRL ("we"). By creating an account or using the Service, you accept these Terms. If you are acting on behalf of an organisation, you represent that you are authorised to bind it.

1. Description of the Service

The Service allows you to connect advertising and analytics accounts (Google Ads, Meta Ads, Google Analytics 4, Google Search Console, Microsoft Clarity, WordPress, etc.), to centralise their performance data, and to receive automated analyses and recommendations. The Service may evolve, and certain features may be added, modified or removed.

2. Account

• You must provide accurate information and keep your account up to date;
• You are responsible for the confidentiality of your credentials and for any activity on your account;
• You must notify us without delay of any unauthorised use;
• You must be a professional and at least 16 years of age.

3. Connections to Third-Party Platforms

When you connect a third-party platform, you authorise us to access the required data in read mode via the official APIs. You warrant that you hold the necessary rights and permissions over those accounts and data. Your use remains subject to the terms of the relevant platforms (in particular Google, Meta and Microsoft); in the event of a conflict, their terms apply to the use of their APIs.

4. Acceptable Use

You agree not to:

• circumvent security measures, attempt to access another workspace's data, or disrupt the Service;
• use the Service for unlawful purposes or in violation of third-party rights;
• reverse-engineer, resell or exploit the Service beyond what is permitted;
• import data for which you have no legal basis.

5. Intellectual Property

The Service, its brand, interface and code remain the property of Winevizer SRL. We grant you a personal, non-exclusive, non-transferable right of use for the duration of your subscription. You retain all rights over your data.

6. Personal Data

The processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

7. Pricing

Any applicable pricing terms will be communicated to you before any paid subscription. [to be completed if a paid offering is available: price, billing, refund, taxes] Otherwise, the Service is provided free of charge or in an evaluation phase, with no guarantee of continuity.

8. Availability and Warranties

The Service is provided "as is" and "as available". We endeavour to maintain reasonable availability but do not guarantee uninterrupted or error-free operation, nor the accuracy of automated recommendations, which do not constitute professional advice. You remain solely responsible for your advertising decisions.

9. Limitation of Liability

To the extent permitted by law, Winevizer SRL shall not be liable for indirect damages, loss of profits, data or opportunities. Our aggregate liability is limited to the amount paid for the Service during the twelve (12) months preceding the event giving rise to the claim. Nothing herein excludes liability that cannot lawfully be excluded.

10. Termination

You may stop using the Service and delete your workspace at any time (see the data deletion instructions). We may suspend or terminate access in the event of a breach of these Terms or for security reasons. Upon termination, the associated data is deleted in accordance with our Privacy Policy.

11. Changes

We may modify the Service or these Terms. Any material change will be indicated on this page with a revised date; continued use constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by Belgian law. Any dispute shall fall within the exclusive jurisdiction of the courts of Mons (Belgium), without prejudice to any mandatory provisions protecting consumers.
